These Terms & Conditions apply to inquiries, quotations, samples, wholesale orders, bulk production, OEM manufacturing, private-label manufacturing, customized products, and other business conducted with MQG – Max Quality Gear.
By placing an order or approving production with MQG, the customer agrees to the applicable quotation, specifications, approvals, payment terms, and these Terms & Conditions unless otherwise agreed in writing.
Business-to-Business Manufacturing
MQG primarily operates as a B2B manufacturer supplying sportswear, combat gear, fitness wear, weightlifting products, and related equipment to brands, wholesalers, distributors, retailers, gyms, clubs, teams, and other commercial buyers.
Our services may include wholesale manufacturing, bulk production, OEM manufacturing, private-label manufacturing, product customization, product development, sampling, custom branding, and custom packaging.
Products displayed on our website primarily demonstrate our manufacturing capabilities. Final materials, specifications, colors, construction, branding, and packaging may vary according to each customer’s approved requirements.
Quotations & Pricing
Quotations are prepared according to the information provided by the customer, including product specifications, materials, quantities, designs, customization, branding, packaging, and delivery requirements.
Pricing may change if the customer changes the quantity, materials, design, specifications, branding, packaging, shipping requirements, or other details after the quotation has been issued.
Unless otherwise stated, quotations should not be considered permanently valid. Current pricing should be confirmed before placing an order.
Minimum Order Quantities
Minimum order quantities (MOQs) may apply to wholesale, customized, OEM, and private-label products.
The required MOQ may vary depending on the product, materials, design, colors, printing method, branding, packaging, and level of customization. The applicable MOQ will be communicated during the quotation process.
Samples & Product Development
Customers may request product samples before proceeding with bulk production.
Sample charges, development costs, tooling costs, shipping expenses, or other applicable charges will be communicated before sample development begins.
Samples are intended to establish and confirm important product details such as materials, construction, dimensions, sizing, colors, artwork, branding, and overall appearance before bulk manufacturing.
Customer Approval
Customers are responsible for carefully reviewing samples, mockups, artwork, specifications, measurements, colors, logos, labels, packaging, and other relevant details before providing final approval.
Bulk production may begin once the required product details have been approved and the agreed payment requirements have been fulfilled.
Customers should verify:
- Product design and construction.
- Measurements and sizing.
- Materials and colors.
- Logos and artwork.
- Printing, sublimation, and embroidery.
- Labels and hangtags.
- Packaging requirements.
- Quantities and product variations.
MQG is not responsible for errors contained in information, artwork, specifications, or other materials supplied or approved by the customer.
Customization & Manufacturing Tolerances
Custom manufacturing involves manual and mechanical production processes. Reasonable variations may therefore occur between samples, individual products, and different production batches.
Minor variations may occur in dimensions, color shades, material appearance, stitching, printing, embroidery, logo placement, weight, finishing, or other manufacturing characteristics.
Reasonable manufacturing tolerances should not automatically be considered defects where they do not materially affect the intended function or approved specifications of the product.
OEM Manufacturing
For OEM manufacturing projects, customers may provide product specifications, technical drawings, tech packs, artwork, measurements, reference samples, or other product information.
MQG will use the approved information as the basis for product development and manufacturing. Customers are responsible for ensuring that all supplied specifications and instructions are accurate and complete.
Private Label Manufacturing
Private-label products may be manufactured using customer-specific logos, labels, hangtags, artwork, colors, packaging, and other branding elements.
Customers are responsible for ensuring that their branding, labeling, product claims, and other supplied information comply with applicable requirements in the markets where the products will be sold.
Customer Artwork & Intellectual Property
Customers are responsible for ensuring that they have the legal right to use all trademarks, logos, brand names, artwork, graphics, designs, and other intellectual property supplied to MQG.
By submitting such materials, the customer confirms that MQG is authorized to use them as reasonably necessary for product development, sampling, manufacturing, printing, branding, packaging, and fulfillment of the customer’s order.
MQG is not responsible for third-party intellectual property claims resulting from materials, designs, trademarks, or branding supplied or specifically requested by the customer.
Payment Terms
Payment terms will be specified in the applicable quotation, proforma invoice, purchase agreement, or other written communication.
Depending on the order, an advance payment may be required before sampling, material procurement, customization, or bulk production begins. Any remaining balance will be payable according to the agreed payment terms.
MQG reserves the right to place sampling, production, or shipment on hold if required payments have not been received.
Banking fees, transfer charges, or other transaction costs may be the customer’s responsibility where applicable.
Production Lead Times
Production lead times depend on product type, quantity, materials, customization, sample approval, production capacity, and other order requirements.
Production schedules provided by MQG are estimates unless a specific delivery commitment has been agreed in writing.
Lead times may be affected by delayed customer approvals, specification changes, delayed payments, material availability, shipping disruptions, or circumstances outside MQG’s reasonable control.
Bulk & Repeat Orders
MQG supports wholesale, bulk, and repeat production for brands, distributors, wholesalers, retailers, gyms, clubs, and other B2B customers.
Previous samples or production specifications may be used as references for repeat orders. However, material availability, color batches, component availability, and other manufacturing factors may change over time.
Customers should therefore confirm important specifications before each repeat production order.
Quality Inspection
MQG carries out quality checks during relevant stages of manufacturing and before products are prepared for shipment.
Inspection is performed against the approved product requirements and reasonable manufacturing standards applicable to the relevant product.
Shipping & Delivery
Shipping method, destination, freight charges, delivery terms, and responsibility for transportation will be agreed for each order.
Where applicable, customers are responsible for import duties, customs charges, taxes, brokerage fees, and other destination-country charges unless specifically agreed otherwise.
International transit times are estimates and may be affected by carriers, freight companies, customs authorities, weather, port congestion, government procedures, or other circumstances outside MQG’s reasonable control.
Inspection Upon Delivery & Claims
Customers should inspect products promptly after receiving their shipment.
Any claim regarding shortages, incorrect products, manufacturing defects, or other order discrepancies should be reported within the period specified in the applicable quotation or sales agreement, or otherwise within a reasonable period after delivery.
Claims should include the relevant order or invoice reference, affected quantities, clear photographs or videos, and other information reasonably required to investigate the issue.
MQG may request affected products or samples for inspection before a resolution is determined.
Custom Orders, Returns & Cancellations
OEM, private-label, customized, and made-to-order products are produced specifically according to individual customer requirements. Such products generally cannot be returned, exchanged, or cancelled simply because the customer changes their mind after production or committed material procurement has begun.
If cancellation is requested before production is completed, any refund or credit will depend on the stage of the order and costs already incurred for product development, sampling, materials, tooling, printing, embroidery, labels, packaging, labor, or other customer-specific requirements.
Nothing in these Terms is intended to exclude rights that cannot lawfully be excluded under applicable law.
Defective or Non-Conforming Products
If products materially fail to meet the approved specifications because of a manufacturing issue attributable to MQG, the claim will be reviewed based on the available evidence and circumstances.
Depending on the nature and extent of a verified issue, an appropriate resolution may include repair, replacement, credit, or another mutually agreed solution.
Confidentiality
Customers may provide MQG with non-public product designs, specifications, pricing information, samples, business information, or other commercially sensitive materials during product development and manufacturing.
Such information should be used responsibly for the relevant business relationship, subject to any separate confidentiality or non-disclosure agreement between the parties.
Customers requiring additional protection for confidential product development may request a separate Non-Disclosure Agreement (NDA).
Website Product Images & Information
Product photographs, samples, mockups, descriptions, colors, and specifications displayed on the MQG website are primarily intended to demonstrate our products and manufacturing capabilities.
Because MQG specializes in customized manufacturing, final products may differ according to each customer’s selected materials, construction, colors, artwork, branding, and approved specifications.
Limitation of Liability
To the extent permitted by applicable law, MQG will not be responsible for indirect, incidental, special, or consequential losses arising from an order, including lost profits, lost sales, business interruption, or losses resulting from third-party carrier or customs delays.
Any additional limitations, remedies, warranties, or obligations applicable to a specific transaction may be stated in the relevant quotation, invoice, purchase agreement, or other written contract.
Force Majeure
MQG will not be responsible for delays or failure to perform caused by circumstances reasonably outside our control.
Such circumstances may include natural disasters, war, civil disturbance, government restrictions, transportation disruption, major utility failures, labor disruption, epidemics, material shortages, port disruption, or similar events beyond reasonable control.
Governing Law
Unless otherwise agreed in writing, these Terms & Conditions are governed by the applicable laws of Pakistan.
Any dispute will be handled according to the applicable agreement between the parties and the jurisdiction provided under applicable law.
Changes to These Terms
MQG may update these Terms & Conditions periodically to reflect changes in our business, manufacturing practices, services, or legal requirements.
Specific orders may also be subject to additional terms stated in the relevant quotation, proforma invoice, purchase agreement, approved specifications, or other written agreement.
